1.GENERAL PROVISIONS
These Terms and Conditions govern the use of VitaTale and the contractual relationship between the user and:

Trade name of the service: VitaTale.
2.MARKETS COVERED BY THESE TERMS
These Terms are designed for VitaTale services offered in:
- Bulgaria;
- Romania;
- Greece;
- Poland;
- Ukraine.
They form one common legal baseline for all five markets.
If mandatory law in the user's country gives the user stronger rights than these Terms, the mandatory rule prevails.
3.EUROPEAN UNION LAW
For consumers in Bulgaria, Romania, Greece and Poland, mandatory European Union law and applicable national implementing law apply, including rules concerning:
- distance contracts;
- pre-contract information;
- withdrawal rights;
- personalised goods;
- conformity of goods;
- digital content and services;
- personal data;
- artificial intelligence;
- electronic commerce.
4.UKRAINIAN LAW
For consumers in Ukraine, mandatory Ukrainian law that applies to the particular sale remains applicable.
These Terms are not intended to waive any mandatory Ukrainian consumer right.
5.WHAT VITATALE IS
The subject of each order is the manufacture and sale of a personalised printed biographical book.
The interview, collection and processing of materials, use of AI, text preparation, editing, book structure, design, layout, work with photographs and family review are stages in preparing and manufacturing the ordered book and are not sold separately.
The on-screen preview is used solely to review and approve the book before printing and is not a separately purchased digital product.
Performance of the order is completed by manufacturing the physical copy of the book and handing it over for delivery to the buyer or a recipient designated by the buyer.
The exact plan, number of copies and other characteristics of the specific order are shown to the buyer before payment.
6.DEFINITIONS
"Buyer" means the person who places and pays for the order.
"Project Owner" means the user with primary control over the project.
"Storyteller" means a person who answers questions and contributes memories.
"Additional Storyteller" means an invited person who contributes additional memories.
"Book Subject" means the person whose life is the main subject of the book.
"Project" means the private VitaTale workspace associated with a particular book.
"Manuscript" means the current version of the book text before production.
"Final Approval" means the action by which the Project Owner approves a specific version of the book for production.
"Personalised Good" means a physical book manufactured using the particular customer's individual text, photographs, memories and configuration.
"Order" means the recorded set of purchase characteristics, including plan, quantity, price, currency, market and other order-specific settings.
7.AGE AND LEGAL CAPACITY
The Buyer must be an adult and have the legal capacity to enter into the contract.
If a user acts on behalf of an organisation or another person, the user confirms that they have the necessary authority.
Only adults may purchase or participate directly. Adults may describe their own childhood and family memories, but VitaTale does not interview children directly in the current version.
8.HOW THE CONTRACT IS FORMED
Before payment, the user must receive clear information about:
- the seller;
- the main characteristics of the service;
- the selected plan;
- the number of books;
- additional paid services;
- the total amount charged by VitaTale;
- currency;
- applicable taxes;
- payment method;
- delivery method;
- carrier charges paid separately, where relevant;
- cancellation and withdrawal rules;
- the personalised nature of the book;
- relevant exceptions from withdrawal rights;
- immediate commencement of the service where requested.
The final order button must make it unambiguous that pressing it creates an obligation to pay.
9.CONTRACT CONFIRMATION
After a distance contract is concluded, VitaTale sends confirmation on a durable medium, such as email, to the extent required by applicable law.
The confirmation should make it possible to reconstruct the material terms of the specific order.
10.VERSION OF THE TERMS
VitaTale should retain evidence of which version of these Terms applied to a particular order.
A later website update must not silently replace the terms of an already paid order.
11.PRICE
The price of a particular order is shown before payment.
The authoritative amount is calculated server-side by VitaTale.
Each paid order should record:
- country or market;
- currency;
- pricing version;
- selected plan;
- quantity;
- discount;
- applicable add-ons;
- total amount charged by VitaTale.
A later change in public pricing does not alter an already paid order.
12.OBVIOUS PRICING ERRORS
If a clearly incorrect price is shown because of an obvious technical error, VitaTale may not simply charge a different amount without agreement.
The situation is handled according to applicable law, including cancellation and a full refund where that is the legally appropriate solution.
13.TAXES
Tax treatment depends on factors including:
- seller location;
- customer location;
- nature of the supply;
- applicable law;
- VitaTale's tax status.
Before each market is opened, VitaTale must ensure that the customer receives the legally required pricing and tax information.
14.PAYMENTS
Payments are currently handled through Stripe.
VitaTale does not store the full payment card number or card security code.
A payment is treated as confirmed only after reliable confirmation from the payment provider.
15.DUPLICATE-PAYMENT AND DUPLICATE-PROJECT PROTECTION
One confirmed payment should not create multiple identical projects.
VitaTale uses technical idempotency and verification controls around payment notifications.
16.ADDITIONAL PURCHASES
A plan upgrade changes the scope or characteristics of the personalised printed book already ordered.
An additional copy is an additional physical printed copy of the same personalised book already ordered.
Adding an additional storyteller is a paid extension of an existing personalised printed book order and is available only within that order.
The additional storyteller's materials are collected and used to prepare the corresponding ordered book. Each extension is applied only after its separate payment is confirmed.
17.PROJECT ACCESS
Users must take reasonable care of:
- access codes;
- private links;
- email access;
- their device.
Private project links should not knowingly be published publicly.
If access may have been compromised, the user should contact VitaTale.
18.INVITED STORYTELLERS
The Project Owner may invite additional storytellers within the number of seats available under the order.
Each storyteller receives a separate private interview context.
Users must not:
- impersonate another storyteller;
- pressure someone to participate;
- share another person's private invitation with outsiders;
- use an invitation to gain access to someone else's private story.
19.REMOVING AN ADDITIONAL STORYTELLER
Before the relevant project stage closes, the Project Owner may remove an additional storyteller if the product provides that function.
Before an irreversible action, VitaTale should explain the consequences.
20.INFORMATION GIVEN TO STORYTELLERS
Before the interview, a storyteller should receive understandable information about:
- who provides the service;
- the purpose of the interview;
- the use of artificial intelligence;
- personal-data processing;
- the ability to skip questions;
- the ability to stop participating.
21.ARTIFICIAL INTELLIGENCE TRANSPARENCY
VitaTale tells users when they are interacting with artificial intelligence unless that fact is already obvious.
For consistency, VitaTale applies this disclosure across all five markets.
22.THE INTERVIEW
The interview is adaptive.
VitaTale does not promise a fixed number of questions unless the selected plan expressly states otherwise.
The number and depth of questions depend on:
- the selected plan;
- the amount of material;
- the completeness of answers;
- topics already covered;
- the need for clarification.
23.THE RIGHT TO SKIP QUESTIONS
A storyteller may:
- skip a question;
- move to another topic;
- end the interview.
VitaTale cannot guarantee a particular depth of book if storytellers provide very limited material.
24.VOICE INPUT
Where voice input is available:
- the recording is used to convert speech to text;
- the original recording is not a permanent part of the project;
- the user should review the recognised text.
VitaTale does not guarantee perfect speech recognition.
25.ROLE OF ARTIFICIAL INTELLIGENCE
Artificial intelligence may be used for:
- analysing answers;
- follow-up questions;
- structuring;
- title suggestions;
- drafting;
- editing;
- consistency checks;
- source-grounding checks.
26.LIMITATIONS OF ARTIFICIAL INTELLIGENCE
Artificial intelligence may:
- misunderstand an answer;
- make an error in a name or date;
- connect events incorrectly;
- state something too confidently;
- miss important context;
- produce awkward writing.
Output is therefore not guaranteed to be factually correct merely because it was generated by the system.
27.VITATALE IS NOT AN OFFICIAL FACT-VERIFICATION SERVICE
Unless a separately purchased service expressly says otherwise, VitaTale:
- does not verify official archives;
- does not conduct investigative journalism;
- does not perform genealogical verification;
- does not notarise facts;
- does not verify medical records;
- does not guarantee objective historical truth.
28.SUBJECTIVE NATURE OF MEMORY
Books are based on human memory.
Different people may remember:
- dates;
- places;
- motives;
- sequences of events;
- another person's words
in different ways.
VitaTale may identify uncertainty or contradiction, but it does not guarantee that one recollection is objectively correct.
29.PROFESSIONAL BIOGRAPHER OR EDITOR
If the selected plan includes professional review, the specialist provides editorial and literary work within the scope described for the plan.
Unless expressly stated otherwise, this is not:
- legal review;
- medical review;
- investigative journalism;
- archival research;
- notarisation.
30.EDIT REQUESTS AND REVISIONS
Before Final Approval, the user may use the available process for comments and revision requests.
If a plan does not promise unlimited revisions, VitaTale may apply reasonable limits to repeated editorial work.
Any material limitation that significantly affects the value of the purchase should be disclosed before payment.
31.PHOTOGRAPHS
A user may upload only photographs that the user has the right to use.
The user confirms that they have the necessary rights to:
- store the photograph;
- provide it to VitaTale;
- include it in the book;
- permit technical processing required for printing.
32.RIGHTS OF PEOPLE SHOWN IN PHOTOGRAPHS
Users must respect the rights of living people shown in photographs.
VitaTale may remove or refuse to use a photograph where there are reasonable grounds to believe its use is unlawful.
33.THIRD-PARTY MATERIAL
Users must respect:
- privacy rights;
- honour and reputation;
- copyright;
- image rights;
- data protection rules.
VitaTale must not be used to distribute unlawful sensitive or defamatory material.
34.SENSITIVE INFORMATION
Users should not provide highly sensitive information about another living person without a lawful basis.
Particular care is required with information concerning:
- health;
- religion;
- political opinions;
- ethnic origin;
- sex life;
- sexual orientation;
- criminal convictions and offences.
35.DIFFICULT LIFE TOPICS
VitaTale may handle difficult memories as voluntary biographical material.
The service is not:
- psychotherapy;
- crisis counselling;
- medical assistance;
- an emergency service.
36.EXCLUDING A STORY FROM THE BOOK
Where the product allows the Project Owner to exclude a particular story before source material moves to the next production stage, the excluded material should not intentionally be used in later book generation.
After a stage closes, editing options may be limited.
37.CREATING THE MANUSCRIPT
The manuscript is created from material that is actually available and permitted for use.
VitaTale should not invent new biographical facts merely to increase page count.
38.BOOK LENGTH
If a plan expressly promises a minimum number of pages, that promise forms part of the contract.
If there is not enough source material, VitaTale should use a reasonable solution, such as:
- continuing the interview;
- requesting additional memories;
- agreeing a shorter book;
- offering another fair remedy.
A book should not silently fall below an expressly guaranteed minimum merely because an internal editor prefers a shorter literary result.
39.PRELIMINARY PAGE ESTIMATES
An estimated page count may differ from the final layout.
Final pagination is determined by the actual typeset book.
Where a page count is presented as a guarantee, section 38 prevails.
40.BOOK PREVIEW
The on-screen preview is used to review the content, page order, photographs and design of the book before printing.
It is not an e-book or a separate product. Production PDF files are internal print-preparation artifacts.
On-screen colour may differ slightly from print because of the display, paper, printing method, colour reproduction and binding.
A minor normal production variation is not automatically a defect.
41.FINAL APPROVAL
Before printing, the Buyer receives an opportunity to review the final version.
By approving it, the Buyer confirms that they have reasonably reviewed:
- the Book Subject's name;
- names of other important people;
- dates;
- places;
- title;
- structure;
- photographs;
- captions;
- text;
- language;
- cover.
42.EVIDENCE OF FINAL APPROVAL
VitaTale should be able to establish:
- who approved the book;
- when approval occurred;
- which specific text version was approved;
- which cover was approved;
- which material elements were included.
An approved version should not be silently replaced with another version.
43.CHANGES AFTER FINAL APPROVAL
After Final Approval, a change may:
- no longer be possible;
- require a new review;
- require renewed approval;
- result in additional costs if production has already started.
44.WHAT FINAL APPROVAL DOES NOT WAIVE
Final Approval does not remove mandatory consumer rights in cases such as:
- manufacturing defects;
- printing the wrong version;
- a VitaTale error introduced after approval;
- damage;
- material non-conformity with the order;
- another situation where mandatory law places responsibility on the seller.
45.PERSONALISED NATURE OF THE PRODUCT
Every physical VitaTale book is made from the specific customer's unique materials.
It is therefore a clearly personalised good.
For European Union markets, this is relevant to the statutory exception from the ordinary withdrawal right for certain personalised goods.
For Ukraine, the corresponding mandatory Ukrainian rules for individually made goods apply.
46.NORMAL PRODUCTION TOLERANCES
Professional printing may involve small normal variations in:
- colour;
- trimming;
- element positioning;
- spine thickness.
Such tolerances do not cover:
- missing pages;
- seriously misaligned printing;
- the wrong book;
- major binding defects;
- another material non-conformity.
47.DELIVERY
Delivery is governed by the separate Delivery Policy and by order-specific information.
Where order-specific information is more specific and lawfully recorded for the particular order, it applies subject to mandatory law.
48.TIMING
VitaTale distinguishes between:
- time spent collecting memories;
- manuscript preparation time;
- professional review time;
- printing time;
- carrier transit time.
Words such as "usually", "approximately" and "on average" do not constitute an unconditional guarantee of delivery on a specific calendar date.
49.ORDERS NEEDED FOR A SPECIAL DATE
If the book is needed for a wedding, anniversary, birthday or another important event, the Buyer should tell VitaTale before placing the order.
A particular date is guaranteed only if VitaTale expressly confirms it.
50.WITHDRAWAL RIGHTS IN THE EUROPEAN UNION
For consumers in Bulgaria, Romania, Greece and Poland, European Union distance-contract rules apply.
They commonly provide a 14-day withdrawal period, but they also contain lawful exceptions, including for certain clearly personalised goods.
Different rules apply to services and digital content.
51.WITHDRAWAL RIGHTS IN UKRAINE
For consumers in Ukraine, mandatory Ukrainian law in force on the date of the contract applies.
VitaTale does not use European Union rules to reduce mandatory Ukrainian rights.
52.START OF PERSONALISED WORK
The buyer expressly asks VitaTale to begin personalised preparation of the ordered book after the first material is submitted. VitaTale retains evidence of that request and of the actual start of individual work.
The preparatory digital stages are performed only to manufacture the specific physical book and are not a separate purchase. The buyer's mandatory rights in case of a defect, non-conformity or non-performance remain protected.
53.CANCELLATION AND REFUNDS
Detailed rules are set out in the separate Withdrawal, Cancellation, Refunds and Complaints Policy.
An internal label such as "non-refundable" cannot override a mandatory consumer right.
54.REFUNDS
An actual refund is processed through the payment infrastructure.
For Stripe payments, VitaTale reconciles the refund using reliable payment-provider notifications.
A local administrative status alone is not proof that money has actually been returned.
55.LEGAL CONFORMITY RIGHTS IN THE EUROPEAN UNION
Consumers in Bulgaria, Romania, Greece and Poland have mandatory rights when goods do not conform to the contract.
At European Union level, new consumer goods are covered by at least a two-year legal conformity period, while national law may provide additional protection.
VitaTale does not replace those statutory rights with its own commercial warranty.
56.COMPLAINTS ABOUT DEFECTS OR NON-CONFORMITY
If a book has a defect or materially fails to conform to the order, the user may contact: hello@vitatale.app
Depending on the applicable law and circumstances, a remedy may include:
- correction;
- reprinting;
- replacement;
- price reduction;
- refund.
57.EVIDENCE OF A DEFECT
To speed up review, VitaTale may ask for:
- order number;
- description;
- photographs;
- date of receipt.
Lack of a photograph does not remove a mandatory right where the law does not require a photograph.
58.LOST SHIPMENTS
Where VitaTale selected or arranged the carrier and applicable law keeps the delivery risk with the seller until the consumer receives the goods, VitaTale does not transfer its own dispute with the carrier to the consumer.
59.INCORRECT DELIVERY INFORMATION
The Buyer must check the recipient information carefully.
If re-delivery is required solely because the Buyer supplied incorrect information, VitaTale may require payment of documented additional costs where permitted by law.
60.RIGHTS IN USER-PROVIDED MATERIAL
Users keep the rights they lawfully hold in their own material.
They grant VitaTale a limited right to use that material only to the extent necessary to:
- provide the service;
- perform artificial-intelligence processing;
- edit the book;
- prepare the book;
- print;
- deliver;
- provide support;
- protect the service;
- comply with law.
61.USING PRIVATE BOOK CONTENT FOR MARKETING
Acceptance of these Terms does not automatically give VitaTale the right to publish:
- book text;
- the Book Subject's name;
- family photographs;
- private quotations
for advertising.
Separate, specific permission is required.
62.RIGHTS IN THE VITATALE PLATFORM
Rights in:
- software code;
- design;
- brand;
- general layout;
- technical processes;
- documentation
remain with VitaTale and the relevant rights holders.
63.RIGHTS IN THE INDIVIDUAL BOOK TEXT
The copyright status of material created with artificial intelligence may differ between jurisdictions.
To the extent VitaTale owns rights that can lawfully be transferred or licensed, the Buyer receives the right to use the personalised book for personal and family purposes.
A user wishing to commercially publish or mass-distribute the book should separately verify rights relating to:
- photographs;
- source texts;
- third-party material;
- public disclosure of information about living people.
64.PROHIBITED USE
Users must not:
- hack VitaTale;
- bypass security controls;
- access another person's project;
- distribute malicious software;
- use the service for fraud;
- unlawfully collect other people's data;
- impersonate VitaTale;
- use the service for unlawful content;
- intentionally interfere with infrastructure.
65.SUSPENSION OF ACCESS
VitaTale may temporarily restrict access where reasonably necessary for:
- security;
- fraud prevention;
- compliance with law;
- protection of third-party rights;
- correction of a critical technical issue.
Restrictions must not be used arbitrarily to avoid performing a paid order.
66.SERVICE AVAILABILITY
VitaTale aims to provide a stable service but does not guarantee that there will never be temporary disruption.
Possible causes include:
- maintenance;
- provider failure;
- network problems;
- force majeure.
If a prolonged disruption makes performance of a paid contract impossible, the user retains the remedies available under applicable law.
67.THIRD-PARTY PROVIDERS
VitaTale uses external providers for functions such as:
- payments;
- computing infrastructure;
- artificial intelligence;
- email;
- printing;
- delivery.
The use of a contractor does not remove VitaTale's responsibility to the consumer where mandatory law places that responsibility on the seller.
68.FORCE MAJEURE
Events outside reasonable control may include:
- natural disasters;
- war;
- widespread communication failures;
- government restrictions;
- border closures;
- major transport disruption;
- other extraordinary events.
The affected party should take reasonable steps to reduce the consequences.
Force majeure does not remove mandatory user rights where the contract ultimately cannot be performed.
69.LIMITATION OF LIABILITY
Nothing in these Terms excludes liability that cannot lawfully be excluded.
To the maximum extent permitted by law, VitaTale is not responsible for consequences arising solely from:
- information knowingly falsified by the user;
- the user's lack of rights in uploaded material;
- the user's deliberate publication of a private access link;
- unlawful distribution of the finished book by the user;
- modification of a received file by the user or a third party;
- the user's breach of clear security instructions.
70.MANDATORY CONSUMER RIGHTS PREVAIL
Any limitation of liability must be read together with mandatory consumer law.
Where a contractual limitation conflicts with a mandatory rule, the mandatory rule applies.
71.CHANGES TO THE SERVICE
VitaTale may improve:
- the interface;
- artificial-intelligence models;
- internal processes;
- technical providers.
Material characteristics of an already paid order should not be retrospectively reduced without a lawful basis.
72.CHANGES TO THESE TERMS
A new version applies to new contracts from its effective date.
Material rights attached to an already paid order are not changed merely by publishing a new version online.
73.SERVICE COMMUNICATIONS
VitaTale may send necessary communications concerning:
- orders;
- access;
- security;
- book status;
- delivery;
- complaints;
- legally significant changes.
These messages are distinct from marketing.
74.GOVERNING LAW
The contract is governed by the law of VitaTale's country of establishment to the extent such a choice is legally permitted.
For consumers, that choice does not deprive them of mandatory protection of the law of their habitual residence where such protection applies under conflict-of-law rules.
75.DISPUTES
Users are encouraged to contact: hello@vitatale.app
Users retain the right to use:
- competent courts;
- consumer-protection authorities;
- data-protection authorities;
- available lawful alternative dispute-resolution mechanisms.
The former European Union Online Dispute Resolution platform is not presented as an active mechanism because it has been discontinued.
76.LANGUAGE VERSIONS
VitaTale may publish these Terms in Bulgarian, Romanian, Greek, Polish, Ukrainian and other supported languages.
All published translations should correspond to the same legal version.
All published language versions are intended to be equivalent. If wording differs, the version used for the order is interpreted consistently with mandatory consumer law; contact VitaTale for clarification.
Any interpretation rule must not deprive a consumer of the right to receive understandable pre-contract information in the language in which the service was offered to them.
77.SEVERABILITY
If one provision is invalid or unenforceable, the remaining provisions continue to apply to the extent possible.
78.COMPLETE CONTRACTUAL FRAMEWORK
The contractual framework for a specific order may include:
- these Terms and Conditions;
- the specific order information;
- the Withdrawal, Cancellation, Refunds and Complaints Policy;
- the Delivery Policy;
- mandatory notices shown before payment.
The Privacy Policy explains personal-data processing and is not used to remove contractual rights.
